Welcome to Medycanna. These Terms and Conditions (the "Terms") govern access to and use of the website [medycanna.com] (the "Site"), as well as the purchase of the products offered through it. We ask that you read them carefully before using the Site or making a purchase.
By browsing, registering, or purchasing any product on the Site, you represent that you have read, understood, and accepted these Terms, as well as our Privacy Notice, Returns and Refunds Policy, Shipping Policy, and Cookie Policy, which form an integral part of this document. If you do not agree, we ask that you refrain from using the Site.

2. Definitions
- Site: the website [medycanna.com] and its subdomains.
- User / Customer: any person who accesses, browses, registers, or purchases products on the Site.
- Products: the wellness items formulated with cannabidiol (CBD) and other goods offered by Medycanna.
- La Cava: a restricted-access section of the Site, reserved for authorized users, with exclusive products and conditions.
- Medycanna Account: the personal registration through which the User can save their products, review their history, and, where applicable, access membership benefits.
3. Legal capacity and age restriction
The Site and the Products are intended exclusively for persons over 18 years of age with the legal capacity to contract under Mexican law.
By making a purchase, the User declares under oath that they are of legal age. Medycanna reserves the right to request official identification to verify age and to cancel any order when there are reasonable grounds to presume that the buyer is a minor. The Products must be kept out of the reach of minors.
4. Medycanna Account
For certain features (saving products to your collection, reviewing your history, or accessing La Cava) you may create a Medycanna Account through a secure access process. The User is responsible for:
- Providing truthful, complete, and up-to-date information.
- Maintaining the confidentiality of their credentials and of the verification codes they receive.
- All activity carried out through their account.
Medycanna may suspend or cancel accounts that breach these Terms, provide false information, or make improper use of the Site.
5. Products, availability, and prices
- The Products are described as accurately as possible. Images are illustrative and may vary from the physical product.
- All prices are expressed in Mexican pesos (MXN) and include Value Added Tax (VAT), unless otherwise indicated. Shipping costs are shown itemized before confirming the purchase, in accordance with the Federal Consumer Protection Law.
- Product availability is subject to stock. Medycanna may modify the catalog, descriptions, and prices at any time, without affecting orders already confirmed.
- In the event of a typographical or system error resulting in a manifestly incorrect price, Medycanna reserves the right to cancel the affected order and refund any amount paid, notifying the Customer beforehand.
6. Purchase process and formation of the contract
In accordance with article 76 BIS 1 of the Federal Consumer Protection Law and the Mexican Standard on electronic commerce, the Site provides the User with mechanisms to verify, confirm, and accept their purchase before completing it.
The contract of sale is formed when the Customer completes payment and Medycanna confirms acceptance of the order by email. That confirmation constitutes proof of the transaction. Medycanna reserves the right to reject or cancel orders due to lack of stock, errors in the information, suspected fraud, or breach of these Terms.
7. Payment methods
The Site accepts the payment methods indicated during the purchase process. Payment processing is carried out through external providers that apply their own security measures; Medycanna does not store complete payment card data. The Customer warrants that the payment methods used belong to them or that they are authorized to use them.
8. Shipping and returns
Delivery conditions, times, coverage, and costs are governed by our Shipping Policy. The conditions for return, exchange, and refund are governed by our Returns and Refunds Policy. Both form part of these Terms.
9. Nature of the products and health disclaimer
Read this section carefully.
Medycanna Products are wellness items formulated with cannabidiol (CBD) derived from hemp. They are not medicines and have not been designed to diagnose, treat, cure, or prevent any disease, unless a specific product holds a health registration stating otherwise.
The information contained on the Site (descriptions, Journal articles, usage rituals, and scientific content) is for informational and educational purposes, and does not replace consultation, diagnosis, or treatment by a health professional.
The Customer acknowledges and accepts that:
- They must consult a physician before using the Products, especially if they have any condition, take medication, or are pregnant or breastfeeding.
- They must not exceed the suggested doses or use the Products as a substitute for medical treatment.
- Results may vary from person to person; Medycanna does not guarantee specific effects.
- The Products must be stored according to the label instructions and kept out of the reach of children and pets (except those expressly formulated for animals, which must be used according to their directions).
10. Health compliance
The Products marketed by Medycanna contain hemp-derived cannabidiol with a THC concentration below 1% and are offered in accordance with the applicable provisions of the General Health Law and the corresponding authorizations or permits before the Federal Commission for the Protection against Sanitary Risks (COFEPRIS). Each batch has its Certificate of Analysis (COA), available for the Customer's review.
11. Intellectual property
All elements of the Site —including the "Medycanna" and "med&canna" brand, the logo, isotype, collection names (Humanos, Animalia, Cava), texts, photographs, illustrations, design, code, and editorial content— are the property of Medycanna or its licensors and are protected by Mexican industrial property and copyright law.
Their reproduction, distribution, modification, or use for commercial purposes without Medycanna's prior written authorization is prohibited. Use of the Site does not grant the User any right over such intellectual property.
12. La Cava (restricted access)
La Cava is an exclusive section of the Site to which access is granted selectively, by invitation or authorization from Medycanna. Access to and the exclusive prices of La Cava are a personal, non-transferable benefit.
Medycanna reserves the right to grant, condition, suspend, or revoke access to La Cava at any time and at its sole discretion, without any obligation to compensate. The exclusive products and prices available in La Cava may differ from those in the general catalog.
13. User conduct
The User undertakes to use the Site lawfully and not to: (i) provide false information; (ii) impersonate others; (iii) compromise the security of the Site or of third parties; (iv) use the Site for fraudulent purposes; or (v) resell the Products without authorization. Breach may result in the cancellation of orders, account suspension, and any applicable legal action.
14. Limitation of liability
To the maximum extent permitted by applicable law, Medycanna will not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the Site or the Products, nor for their misuse by the Customer. Nothing in these Terms limits the non-waivable rights that the Federal Consumer Protection Law grants to consumers, nor Medycanna's liability for defective products under that law.
Medycanna endeavors to keep the Site available and error-free, but does not guarantee uninterrupted operation. We may temporarily suspend the Site for maintenance or force majeure.
15. Third-party links and services
The Site may contain links to third-party sites or services (for example, payment gateways or social networks). Medycanna does not control or take responsibility for the content, policies, or practices of such third parties, whose use is governed by their own terms.
16. Personal data protection
The processing of the User's personal data is carried out in accordance with the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and our Privacy Notice, available on the Site, which describes the purposes of processing and the means to exercise ARCO rights (Access, Rectification, Cancellation, and Opposition).
17. Changes to the Terms
Medycanna may modify these Terms at any time. The version in effect will be the one published on the Site at the time of each purchase or use. Continued use of the Site after a modification implies acceptance of the updated Terms.
18. Applicable law and jurisdiction
These Terms are governed by the laws of the United Mexican States. For their interpretation and performance, as well as for any dispute, the parties submit to the jurisdiction of the Federal Consumer Protection Agency (PROFECO) in the administrative sphere and, where applicable, to the competent courts of Zapopan, Jalisco, waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles.

19. Severability
If any provision of these Terms is declared null or unenforceable by a competent authority, the remaining provisions will retain full validity and effect.
